Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Kalluba (the “Platform”), including our website, mobile experiences, and related services (the “Services”). By creating an account, browsing, buying, selling, or otherwise using the Platform, you agree to these Terms.

1. Introduction

In these Terms, “Kalluba”, “we”, “us”, and “our” refer to the operator of the Platform. “You” refers to any user of the Platform, including buyers and sellers.

Kalluba is a marketplace for digital goods and services (for example: subscriptions, digital items/content, gift cards, and account-related services). Sellers list offers, and buyers purchase them. Unless explicitly stated otherwise, Kalluba is not a party to the contract between buyers and sellers, but we provide tooling to facilitate payments, delivery, and dispute resolution.

2. Eligibility

  • You must be at least 18 years old, or have permission and supervision from a parent/legal guardian.
  • You must provide accurate, complete information and keep it updated.
  • You must comply with applicable laws and sanctions restrictions. We may restrict access where required by law or risk policy.

3. Accounts & security

  • Account security: you are responsible for activity on your account. Keep your password and devices secure and notify us if you suspect unauthorized access.
  • One person, one account: we may limit or suspend accounts created to impersonate others or to circumvent restrictions.
  • Verification (KYC): we may require identity verification for sellers and/or for certain activities (e.g., withdrawals, high-risk categories, fraud prevention). You agree to cooperate with verification requests.

4. Marketplace rules

For sellers

  • You must accurately describe what you are selling and what the buyer will receive (including limitations, region locks, eligibility, or required information).
  • You must deliver within the delivery method and timelines stated on your listing and within the Platform’s workflow.
  • You may not move transactions off-platform or request direct payment outside Kalluba.

For buyers

  • Review listing details carefully before paying. Digital goods may be irreversible once delivered.
  • Provide required delivery information accurately (e.g., account identifiers, usernames, or instructions). You are responsible for errors in information you provide.

5. Orders, delivery & completion

  • After payment, an order is created and the seller is expected to deliver using Kalluba’s delivery and chat tools.
  • When an order is marked as delivered, the buyer should verify delivery promptly and confirm receipt if satisfied.
  • For certain orders, the Platform may auto-complete an order after a grace period if the buyer does not confirm receipt or open a dispute within the allowed time.
  • Abuse of the delivery/receipt process (by buyer or seller) may lead to account restrictions.

6. Payments, wallet & payouts

Kalluba supports payments through supported payment methods and partners. Depending on your region and features enabled, we may offer wallet balances for purchases and seller earnings.

  • Escrow-like flow: for many orders, funds are released to the seller after buyer confirmation, auto-completion, or dispute resolution.
  • Payouts: sellers may withdraw available earnings to a linked bank account, subject to verification, risk checks, and minimum thresholds.
  • Fraud prevention: we may delay, hold, or reverse payouts where required to manage risk, chargebacks, disputes, or suspected policy violations.

7. Disputes, refunds & chargebacks

If there is a problem with an order (for example: non-delivery, misdescription, or delivery issues), buyers and sellers should attempt to resolve it through the Platform’s chat first. If it cannot be resolved, a dispute can be opened through the Platform’s Resolution Center.

  • We may request evidence (chat history, screenshots, files, timestamps) to investigate disputes.
  • Where appropriate, we may refund the buyer, release funds to the seller, or take other actions consistent with platform policy and applicable law.
  • Chargebacks: if you file a chargeback or payment dispute outside Kalluba, we may pause dispute handling and/or place holds on related funds while the payment provider investigates.
  • Digital goods/services are often non-returnable. Refunds are generally limited to cases like non-delivery, materially not as described, or fraud, subject to investigation.

8. Fees & taxes

  • Fees (including platform fees and payment processing fees) may apply and will be shown in the checkout and/or order flow.
  • You are responsible for any taxes that may apply to your purchases or earnings.

9. User content & intellectual property

  • You own the content you submit, but you grant Kalluba a limited license to host, display, and process it to operate the Platform (e.g., listings, messages, attachments).
  • Do not infringe third-party intellectual property. We may remove listings or content that appears to violate rights or laws.
  • Kalluba’s software, branding, and designs are protected by intellectual property laws.

10. Prohibited use

You must not use Kalluba to:

  • sell stolen, fraudulent, or illegal goods/services;
  • sell hacked/compromised accounts, credentials obtained unlawfully, or accounts created with false identity;
  • distribute malware, phishing content, or anything that compromises security;
  • harass, threaten, exploit, or deceive other users;
  • bypass platform fees, move transactions off-platform, or manipulate the dispute process.

11. Suspension & termination

We may suspend, restrict, or terminate accounts or access to Services if we reasonably believe you violated these Terms, platform policies, or applicable law, or if needed for safety, fraud prevention, or risk management.

12. Disclaimers & limitation of liability

  • The Platform is provided “as is” and “as available”. We do not guarantee uninterrupted access or that defects will be corrected immediately.
  • Buyers and sellers are responsible for their listings, communications, and performance. Kalluba does not guarantee the quality, legality, or suitability of third-party offers.
  • To the maximum extent permitted by law, Kalluba will not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or goodwill.
